SERIOUS CRIME
Our Approach to Pre-Charge Representation
The period between investigation and charge is often the most critical — and the most overlooked. Decisions made at this stage by police and prosecutors directly affect whether a case proceeds, and on what basis.
At Lostock Legal, we specialise in pre-charge representation. We engage with investigators, attend voluntary interviews, challenge bail conditions, and make proactive representations to the CPS — all with the aim of preventing a charge before it happens.
Not everyone investigated is charged. The right advice at the right time makes all the difference.
Our Approach to Serious Crime Cases
Serious crime allegations — from murder and conspiracy to drug supply and terrorism — demand the highest level of specialist defence. These cases carry the longest sentences, the most complex evidence, and the greatest scrutiny from prosecutors and the courts.
At Lostock Legal, we have the experience and resource to handle the most serious cases from investigation through to trial. We build defences that are robust, evidence-led, and focused entirely on your outcome.
The earlier we are instructed, the more we can do to shape the case before it reaches court.
Areas We Advise On
Conspiracy to Supply Drugs
Conspiracy charges are broad and often brought against multiple defendants. We advise on the extent of alleged involvement, cell site and telephone evidence, and building a defence that isolates your individual role.
Drug Offences
From possession to supply and production, drug offences cover a wide range of conduct and carry significant sentences. We challenge search and seizure, forensic evidence, and intent — from arrest through to trial.
Conspiracy to Murder
One of the most serious charges in criminal law, carrying a mandatory life sentence. We provide specialist defence on joint enterprise, the extent of alleged involvement, and the reliability of prosecution evidence.
Firearms
Firearms offences carry mandatory minimum sentences in many cases. We advise on possession, supply, and discharge offences — including on the availability of exceptional circumstances arguments to avoid mandatory terms.
Joint Enterprise
Joint enterprise prosecutions have faced significant legal challenge following the Supreme Court's ruling in R v Jogee. We advise on the extent of alleged participation and challenge whether the prosecution can establish the necessary mental element.
County Lines Drug Offences
County lines investigations involve multiple defendants, complex telephone evidence, and often allegations of exploitation. We advise on modern slavery defences, the extent of involvement, and challenging cell site analysis.
Murder & Manslaughter
The most serious offences in the criminal calendar. We advise on defences including self-defence, loss of control, diminished responsibility, and gross negligence manslaughter — working with leading counsel where required.
Modern Slavery
Modern slavery can be both a charge and a defence. We advise on trafficking, exploitation, and labour abuse offences — and on the statutory defence available to victims of modern slavery who have been compelled to offend.
Terrorism
Terrorism investigations involve specialist police units, extensive surveillance evidence, and complex legislation. We advise from the point of arrest, on Schedule 7 stops, and through to trial in the Crown Court.
Assisting an Offender
An offence under s.4 of the Criminal Law Act 1967, often arising where someone is alleged to have helped another person evade arrest or investigation. We advise on the scope of the offence and available defences.
