Historic Sexual Allegations

Historic sexual allegations refer to accusations of sexual offences that are made long after the alleged incidents occurred. These cases can be particularly challenging due to the passage of time, which often complicates evidence gathering and the ability to mount a robust defence.

In England and Wales, there is no statute of limitations for prosecuting most sexual offences. This means that individuals can be charged with such crimes regardless of how much time has passed since the alleged incident. The Crown Prosecution Service (CPS) may choose to prosecute historic sexual assault allegations if there is a realistic prospect of conviction and if it is deemed to be in the public interest to do so.

However, there is a notable exception: under the Sexual Offences Act 1956, a one-year time limit applied to prosecutions for “unlawful sexual intercourse” with girls aged 13 to 15. This provision was abolished with the enactment of the Sexual Offences Act 2003 on 1 May 2004. Consequently, any alleged offences occurring before this date are subject to the laws in force at the time, and the one-year time limit applies.
